CONTEST TERMS AND CONDITIONS

Please read these rules ("Official Rules") before entering this contest ("Contest"). You agree that, by submitting an entry, you will be bound by these Official Rules and you acknowledge that you will comply with all the Contest’s eligibility requirements.

This quiz competition / contest titled DQ@7 ("Contest") is made available to you by The Malayala Manorama Company Limited ("Manorama Online"/ "MM"). This a sponsor driven Contest in association with “Asian Paints Apcolite Rust Shield” (“Sponsor”) / The sponsor of this Contest is “Asian Paints Apcolite Rust Shield” (“Sponsor”). The questions of the Contest shall predominantly be general knowledge questions. But a few question will be related to the product/s of the Sponsor of the Quiz i.e. “Asian Paints Apcolite Rust Shield”. Please read these terms and conditions ("T&Cs") before entering the Contest. You agree that, by participating in this Contest, you will be bound by these T&Cs and you acknowledge that you comply with all the Contest’s eligibility requirements as provided herein below.

These T&Cs are in addition to the manoramaonline.com Conditions of Use to which you agree by using the manoramaonline.com website or mobile/tablet application or mobile site thereof (collectively hereinafter referred to as "manoramaonline.com"). To the extent the manoramaonline.com Conditions of Use are inconsistent with these T&Cs, these T&Cs will prevail with respect to the Contest only. For the purposes of these T&Cs, wherever the context so requires "You" or "Your" shall mean any natural person who is a participant in the Contest.

ELIGIBILITY:

You need to fulfil the following eligibility criteria to enter the Contest:

• (i) You should be an individual legal resident of the Republic of India;
• (ii) You should have set India as your current country in your account settings on manoramaonline.com;
• (iii) You should be 18 years of age or above at the time of entry into the Contest.

Our employees, their immediate family members (spouses, domestic partners, parents, grandparents, siblings, children and grandchildren), and our affiliates, advisors, advertising/Contest agencies are not eligible to enter the Contest

DETAILS OF THE CONTEST AND HOW TO ENTER:

1. This Contest will commence from 01 December  2020 at 06:55:00 PM. (IST) and end on or before 30 Decemeber 2020 at 06:55:00 p.m. (IST) ("Contest Period").
2. In order to be eligible for the Contest, during the Contest Period you must: (a) download the mobile/tablet application of manoramaonline.com ("Manorama Online News App - Malayala Manorama App"); (b) thereafter, sign-in to or sign-up from an account on the manoramaonline.com App. Please note login to the app is required to play the live quiz; (c) 'Join this game' button will appear once the countdown starts five minutes before the quiz time. Contest is open only for the first 1 Lakh users who have clicked the 'Join this game' button. By clicking the ''Join this game'' button you are agreeing to the Official Rules and (d) Once logged in, the session will continue until manually logged out by the user or by any other reasons.
3. Daily 10 multiple choice questions will be asked. Each question will carry 10 points. Tap the answer you think is correct; no penalty for incorrect answers. The questions will appear on the screen of your device during the designated time mentioned in clause no.1 referred above. One question will pop up at a time and you will be provided 10 seconds for answering each question. A lag in the starting time may be noticed in the different devices and networks at times. You may also notice a slight difference in the loading time of the quiz questions on different devices. The differences depend on factors such us network speed, device specification, OS versions etc. Before the selection of the winner, a latency period is allotted to overcome the above said points.
4. There will be 10 lucky daily prize winners and 5 lucky monthly prize winners who will be selected from amongst the Participants who have answered the qualifying contest questions correctly.
5. Any person who answer correctly any 5 question i.e. who earns 50 or more points in a day will be shortlisted /qualified for daily prize.
6. Upon answering the Contest questions correctly within the time period communicated by MM, the selected participants may win daily and monthly prizes. 10 daily lucky winners will get INR.800/- (Rupees Eight Hundred Only) each and 5 Monthly lucky winners will get INR.5,000/- (Rupees Five Thousand Only) each (hereinafter referred to as "Prize"). Each registrant will be eligible to receive only one Prize under this Contest during the entire Contest Period.

PRIZE WINNING

1. The draw for the selection of the winners of the Contest will be aggregated at the end of the Contest Period. After we confirm the winning Participant, we will post the winning Participants names on the designated page as per the contest schedule. We will notify the winning participants by e-mail following the draw to provide the required details (i.e Name, Address, contact details, email id, Name of the Bank, branch, Account no., IFSC code, duly attested copy of any government issued ID, PAN, etc) to facilitate the transfer of the winning(s). The Winning Participant needs to share their details within 7 days and MM shall make the payment within -- bank working days of receipt of the above said details in proper order. In case the details are not shared within 7 days of the above email, the prize amount will be forfeited.
2. Any and all taxes and/or levies applicable on the prize money won by the Winning Participant under the laws of India shall be borne by the Winning Participant in relation to the prize. Payment of prize money to the Winner shall be after deduction of all applicable taxes and levies and subject to providing the relevant documents as intimated by the Company and will be paid within the time stipulated by the Company. While releasing prize amount, MM shall deduct the tax at source (if applicable) and issue TDS certificate in the name of the Winning Participant.
3. The winning participants will automatically forfeit their claim to the Prize if they do not meet the eligibility criteria or do not comply with these T&Cs. There are no other prize alternatives available in whole or in part. If any selected participant does not respond back to any communications sent in relation to the Contest within the stipulated time period communicated by MM, or answers the Contest question incorrectly, he/she shall not be eligible to be declared winner of the Prize.

GENERAL TERMS AND CONDITIONS

1. We may be running similar contests or promotions at the same time as this Contest. By entering this Contest, you will not be eligible to receive any benefit awarded in any other promotion / contest unless you enter each promotion / contest separately.
2. We may, to the maximum extent be permitted by applicable law and in our sole discretion, change the T&Cs or cancel the Contest at any time; or modify, terminate, or suspend the Contest should computer anomalies such as viruses, worms, bugs, unauthorized human intervention or other causes beyond our control corrupt or impair the administration, security, fairness or proper play of the Contest or submission of entries.
3. We are not responsible for: (a) lost, misdirected, late, incomplete, or unintelligible entries or for inaccurate entry information, whether caused by you or by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human error that may occur in the processing of entries; (b) any printing or typographical errors in any materials associated with the Contest; (c) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website; or (d) injury or damage to your or any other computer or mobile resulting from downloading any materials in connection with the Contest.
4. We may at in our sole discretion, disqualify any individual found to be : (a) tampering with the entry process or the operation of the Contest or website or mobile application; (b) acting in violation of these T&Cs; or (c) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person.
5. If your entry is incomplete or if you use robotic, automatic, programmed or similar entry methods, your entry will be void. The authorized subscriber of the e-mail account used to enter the Contest at the actual time of entry will be deemed to be the participant and must comply with these T&Cs in the event of a dispute as to entries submitted by multiple users having the same e-mail account. The authorized account subscriber is the natural person who is assigned an e-mail address by an internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domains associated with the submitted e-mail addresses. No benefits greater than those described in the "Description of the Contest and How to Enter" section above in these T&Cs will be awarded.
6. MM will not entertain any claims / questions / queries with respect to the authenticity or correctness of any questions and answers for the questions asked in any round of the quiz. MM’s decision on the correctness or incorrectness of any answer is final and binding on all Participants.
7. By entering the Contest, you consent to being placed on a mailing list for promotional and other materials by MM/Sponsor. You may update or change your email preferences at the email preferences page. By entering the Contest, you further give your consent to MM to provide your contact details to the sponsor. Use of the provided information by the sponsor of the information is subject to their individual Privacy Policy.
8. The Contest is governed by the laws of the Republic of India. The Contest and all accompanying materials are © 2020 by The Malayala Manorama Company Limited, or its affiliates. All rights reserved. No requests for transfer or assignment or redemption of the benefits shall be entertained. You agree that all our decisions related to the Contest are final and binding on you. Failure by MM to enforce any of these T&Cs in any instance shall not be deemed to be a waiver of the T&Cs and shall not give rise to any claim by any person. The decision of MM shall at all times be binding and final. These T&Cs are subject to Indian laws and the courts at Kottayam shall have the exclusive jurisdiction in respect of any disputes or any matter arising here from.
9. This Contest is subject to force majeure circumstances including without limitation, floods, natural disasters, war, act of terror, political unrests, technical snags, act of God, change in laws or any circumstance beyond the reasonable control of MM ("Force Majeure Event"). MM shall be not liable for any delay or adverse effect caused to the participants in the Contest including the winners as a result of a Force Majeure Event.
10. This Contest is being made purely on a "best effort" basis and participating in this Contest is voluntary. By participating in the Contest, you will be legally bound hereby, to release from liability, and hold harmless MM, and any of its affiliates, employees or agents representing or related to MM and its services/products. This release is for any and all liability for personal injuries (including death), property loss or damage, and misuse of the benefits/ Prizes offered under this Contest, in connection with any activity or directly or indirectly, by reason of the acceptance, possession, or participation in the Contest, even if caused or contributed to by our negligence.
11. All information submitted in connection with this Contest will be treated in accordance with these T&Cs and the Privacy Notice available at manoramaonline.com.

PUBLICITY RELEASE

By participating in the Contest, you give MM and/ or its affiliates permission to use your name, likeness, image, voice, and/or appearance as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images, and the like, taken or made in relation to the Contest and any promotions, events, or contests to follow. You agree that MM and/ or its affiliates have the right to publish your saved details for any communication, promotions, events, or contests that follow. You agree that MM and/ or its affiliates have complete ownership of such pictures, etc., including the entire copyright, and may use them for any purpose. These uses include, but are not limited to illustrations, bulletins, exhibitions, videotapes, reprints, reproductions, publications, advertisements and any promotional or educational materials in any medium now known or later developed, including the internet. You acknowledge that you will not receive any compensation, etc. for the use of such pictures, etc., and hereby release MM and/ or its affiliates and its agents and assigns from any and all claims which arise out of or are in any way connected with such use. You give your consent to MM and/or its affiliates, agents and assigns to use your name and likeness to promote the Contest and any promotions, events, or contests to follow.
